This class action alleges that certain Volkswagen and Audi diesel-powered automobiles contain a software device that detects when these cars are undergoing emissions testing and triggers activation of the cars’ full emissions control systems. In ordinary driving conditions, these cars emit 10 to 40 times more than the allowable legal levels of certain pollutants. This action seeks damages on behalf of people that own and/or lease the affected vehicles, which include: TDI Volkswagen Golf (model years 2009 to 2015), Jetta (model years 2009 to 2015), Beetle (model years 2013 to 2015), Golf Wagon/Sportwagon (model years 2009 to 2015), Passat (model years 2012-2015), and Audi A3 (model years 2009 to 2015), A1, A3, A4, A5, A6, TT, Q3, and Q5.
Settlements were reached in the litigation, which resolve the litigation in its entirety. The claims deadline for filing a claim within the 2.0-Litre TDI Emissions Settlement was December 30, 2018. The claims deadline for filing a claim within the 3.0-Litre Diesel Emissions Settlement was August 31, 2019.
The settlement periods have now concluded and all approved claims have been paid.

2.0-Litre TDI Emissions Settlement
December 30, 2018 was the Claims Period Deadline for the Volkswagen/Audi 2.0L TDI (Diesel) Emissions Settlement in Canada. This was the deadline to complete a Buyback, Buyback With Trade-In, Early Lease Termination, or Surrender for Inoperability. It was also the deadline to complete the Approved Emissions Modification for the purposes of receiving the associated AEM Damage Payment. If you have not submitted an approved claim and received your benefits before the deadline you are no longer eligible to participate in the court approved settlement.

May 31, 2019 – Claims Submission Deadline: Deadline to complete a valid claim, including submitting required documents. You must submit your claim, including all required documents, online via the Online Claims Portal or through mail using the Paper Claim Form by May 31, 2019. To avoid having your claim considered ineligible, all requested information and documentation must be completed by May 31, 2019. To ensure that you have time to correct any document deficiencies, you should submit your documents by April 30, 2019, or earlier if possible.
