Siskinds has filed a copyright class action lawsuit against Suno Inc. Generative AI allegedly infringed copyrighted works
Generative AI music services are software products designed to produce audio content that mimics human-created music in response to a user’s prompt. These systems rely on machine learning models built by exposing software to large quantities of existing audio recordings, so that the resulting model can identify and later reproduce melodic, rhythmic, and stylistic patterns found in that training data. This class action alleges that training data were created by copying and appropriating a wide array of publicly accessible, copyright-protected works without authorization. By doing so, the defendants infringed on the plaintiffs’ exclusive rights and created competing products that reproduce or mimic these protected works. The defendants’ actions have caused significant harm to the proposed class members, including damages resulting from the unauthorized reproduction of their protected works and the development of competing models and outputs.
Who can join the Suno copyright class action?
The class action seeks to represent all Canadian residents, other than Excluded Persons, who on or before the date of certification, were the:
(a) author of a Class Work;
(b) performer of a Class Work;
(c) maker (producer) of, or owner of copyright in a Class Work; or
(d) an assignee, licensee, heir, or other recipient or holder of copyright in a Class Work of any person listed in paragraphs (a)-(c),
whose Class Work appeared at any time in the Defendant’s Training Data or whose Class Work, or a substantial part thereof, were reproduced in the outputs of the Defendant’s Music Service.
“Excluded Persons” means: (i) any person identified in (a), (b), or (c) who has transferred to SOCAN, or granted SOCAN the exclusive right to administer, their respective SOCAN Rights, without retaining any rights in a Class Work; or (ii) the Defendant, the Defendant’s co-conspirators, aiders and abettors, and members of their immediate families; Defendant’s corporate parents, subsidiaries, and affiliates; Defendant’s directors, officers, employees and other agents, as well as members of their immediate families; all government entities; the judges and chambers staff in this case, as well as any members of their immediate families.
This class action lawsuit against Suno Inc. was commenced in British Columbia by Notice of Civil Claim on September 3, 2026.
