On March 28, 2019, Siskinds LLP comenced a class action against Kia Canada Inc., Kia Motors America Inc., Kia Motors Manufacturing Georgia Inc, and Kia Motors Corporation (collectively, “Kia”) alleging that the panoramic sunroofs installed in certain vehicles are susceptible to spontaneous shattering.

On May 27, 2019, Siskinds’ Québec-based affiliate, Siskinds Desmeules, commenced a similar class action for Quebec’s residents. A copy of the application for authorization to institute a class action can be found here.

The affected vehicles include:

  • 2011-2019 model year Kia Sorento vehicles;
  • 2011-2019 model year Kia Optima vehicles;
  • 2011-2019 model year Kia Sportage vehicles;
  • 2014-2019 model year Kia Soul vehicles; and
  • 2014-2019 model year Kia Cadenza vehicles.

The action seeks to represent all persons in Canada who purchased one of the vehicles listed above.

There are no steps required to “join” the class action. Unless you opt-out (excluded yourself from the class action), assuming you fall within the scope of the class definition, you are automatically included in the class action.
