On December 5, 2025, Siskinds LLP commenced a proposed consumer class action in the Supreme Court of British Columbia against SAS Institute (Canada) Inc., SAS Institute Inc., and Integrated Decisions and Systems, Inc. (collectively “IDeaS”); and the hotels owned, managed, operated, or franchised by the following including:
- Accor
- APA (including Coast Hotels)
- The Burrard
- Chelsea Hotel
- Choice
- Four Seasons
- The Hazelton Hotel
- Hilton
- Hotel Arts
- Hyatt
- Omni
- Wyndham
(collectively “Hotel Defendants”)
This action arises from a conspiracy to fix, raise, maintain, and/or stabilize hotel room prices in Canada using a software pricing algorithm. The Hotel Defendants, who are competitors, agreed to provide confidential pricing information to IDeaS, which earned fees by developing and deploying a pricing algorithm to make pricing decisions for the Hotel Defendants. The Hotel Defendants were urged to and agreed or arranged to accept the decisions made by the pricing algorithm because doing so would result in higher prices that they would otherwise not be able to achieve.
The class action alleges that because of the Defendants’ conduct, consumers paid inflated, non-competitive prices for their hotel rooms in Canada.
The class action is brought on behalf of all persons who paid for a room at a hotel in Canada that is owned, managed, operated, or franchised by the Hotel Defendants from September 28, 2016 to the date of certification.
A similar class action ws commenced in Quebec by Siskinds Desmeules also on December 5, 2025, for all persons who paid for a room at a hotel in Quebec.
