On May 21, 2025, Siskinds LLP commenced a proposed consumer class action in the Ontario Superior Court of Justice against Canada’s Wonderland Company and Six Flags Entertainment Corporation (collectively “Wonderland”).
Misleading online pricing by Canada’s Wonderland
The class action alleges that Canadian consumers attending Wonderland are unable to purchase Park Services online at the Advertised Price. Park Services means Wonderland park admissions (including both daily admission and season passes), and related add-on services, including but not limited to:
- Fast Lane pass (bypasses regular lines on 22 attractions)
- Fast Lane Plus pass (bypasses regular lines on 26 attractions)
- Dining bundles
- “Good Any Day” admission
- FunPix service (digital downloads of FunPix photos)
- VIP Lounge access
- Cabana rentals
- Parking
Wonderland allegedly breaches Ontario’s Consumer Protection Act
The class action lawsuit by Siskinds alleges that Wonderland breached the Ontario Consumer Protection Act, 2002 by failing to provide fair and transparent pricing details. The claim alleges that Wonderland misrepresented their Advertised Price by not disclosing the Processing Fee and/or disclosing the Processing Fee in a manner that was not obvious to consumers. The Processing Fee was charged in pre-determined set amounts of $0.99, $6.99, $8.99 or $9.99, based on the number and type of Park Services selected. The Processing Fee is imposed by Wonderland for Park Services purchased online on Wonderland’s website (canadaswonderland.com) or on Wonderland’s app, in addition to the Advertised Price.
Canada’s Wonderland class action eligibility
The class action is brought on behalf of all persons in Canada who purchased Park Services online from the Canada's Wonderland website and/or app from the date that Wonderland first implemented the Processing Fee to the date of certification. The class action seeks to recover damages in an amount equal to the difference between the Advertised Price and the all-in price (i.e., the Processing Fee).

FAQs
Do I have to pay anything to participate in the class action?
Class action lawyers are usually paid on a contingency basis. This means that class action legal counsel are only paid if successful. Class counsel are paid a percentage of any settlement or court award. Class counsel fees are subject to court approval.
Can I join the Canada's Wonderland class action?
There are no steps required to “join” the class action. Assuming you fall within the scope of the class definition, you are automatically included in the class action unless you “opt-out” (exclude yourself from the class action) after the lawsuit against Canada’s Wonderland has been certified as a class action. Notices will be issued to the affected persons after the court certifies the class action.
Can I opt-out of the class action against Canada’s Wonderland?
Once the class action has been certified, you will have the opportunity to opt-out of the class action within a period of time to be determined by the Court. If you exclude yourself, you will not be entitled to any compensation awarded under a settlement agreement or court order. You may, however, pursue your own legal action on an individual basis.
Generally, class members will wish to exclude themselves from a class action if they intend to bring their own individual action. In the majority of cases, it will be more economical to participate in the class action lawsuit because the legal costs will be shared among a very large number of people.
What should I do to protect my rights?
To protect your rights, you should:
- Keep any documents evidencing your purchase of a Wonderland Park Service purchased online on Wonderland’s website (canadaswonderland.com) and/or app.
- While the Canada's Wonderland class action is pending, notices will be disseminated to the class members advising that they should take certain steps by specific deadlines in order to preserve their rights. This information will also be made available on Siskinds’ website. These deadlines will usually be fixed by the courts and will need to be adhered with in order to protect your rights.
