flameThe Alberta Court of Appeal has held an Ontario waste hauler partly liable for an incinerator explosion. In Wainwright (Town) v. 876947 Ontario Ltd.,  the hauler  was found to know that the waste was flammable, but was negligent in communicating this information clearly to an Alberta waste broker. The broker forwarded the lacquer- containing sawdust to an incinerator for non-hazardous waste, where it exploded. The Alberta broker was also held to be contributorily negligent, and liable for 30% of the loss.
