In October 2025, Siskinds LLP commenced a proposed privacy class action in the Supreme Court of British Columbia against Bytedance Ltd., TikTok Ltd., TikTok Technology Canada Inc., and TikTok Pte Ltd. (collectively referred to as “TikTok”).

The proposed class action lawsuit relates to allegations that TikTok collected, used, and monetized users’ personal information (including that of children and teen users) for advertising purposes – without obtaining proper consent or providing a meaningful opportunity to opt out of TikTok’s data collection processes. 

Who is included in the TikTok class action? 

The class action is brought on behalf of all persons in Canada, other than Québec, who use or used the TikTok app between October 29, 2021, to the date of certification of this action.

If you used TikTok in Canada during this period and believe your personal data or privacy rights were affected, you may be eligible to join the TikTok privacy class action lawsuit. 

TikTok accused of failing to protect users’ personal data 

On September 23, 2025, Offices of Privacy Commissioners for Canada, British Columbia, Québec, and Alberta published the results of a joint investigation focused on TikTok, one of the most widely used social media platforms among Canadian teens and children. The investigation was conducted with the ultimate goal of creating “a safer, more transparent online environment for children,” and gives us a glimpse into the vast realm of information collected by TikTok about its users. The Commissioners concluded that TikTok hasn’t been doing enough to protect the privacy of users, namely the hundreds of thousands of Canadian children that access TikTok’s platform each year. TikTok’s data collection and consent mechanisms were insufficient. These findings raise significant concerns about privacy online, data transparency, and social media accountability under Canadian privacy law, particularly when it comes to children and teens.

Can I join the TikTok class action? 

There are no steps required to “join” the TikTok data collection class action. Assuming you fall within the scope of the class definition, you are automatically included in the class action unless you “opt-out” (exclude yourself from the class action) after the lawsuit has been certified as a class action. Notices will be issued to the affected persons after the court certifies the class action.

Can I opt-out of the class action?

Once the class action has been certified, you will have the opportunity to opt-out of the class action within a period of time to be determined by the Court. If you exclude yourself, you will not be entitled to any compensation awarded under a settlement agreement or court order. You may however pursue your own action on an individual basis.

Generally, class members will wish to exclude themselves from a class action if they intend to bring their own individual action. In the majority of cases, it will be more economical to participate in the class action because the legal costs will be shared among a very large number of people.

What should I do to protect my rights?

To protect your rights, you should:

  1. Keep any emails or other communications that you received when you signed up for a TikTok account.
  2. While the class action is pending, notices will be disseminated to the class members advising that they should take certain steps by specific deadlines in order to preserve their rights. This information will also be made available on Siskinds’ website. These deadlines will usually be fixed by the courts, and will need to be adhered with in order to protect your rights.
