The Ministry of the Environment has amended Ontario Regulation 153/04, under the Environmental Protection Act (EPA), related to brownfields. According to the MOE, the amendments “are technical and are consistent with the policy intent of the existing O. Reg. 153/04, as amended in December 2009. The amendments clarify the intent and scope of certain provisions, correct for minor errors and incorporate new data, all in support of the safe and efficient redevelopment of brownfield sites.” The amendments received general support from a multi-stakeholder group earlier this year, and will come into effect with other major revisions July 1, 2011.

The amending regulation, O. Reg. 179/11, has been filed with the Registrar of Regulations and is expected to be posted on e-Laws on May 30, 2011 and on the Ontario Gazette on June 11, 2011.
