On June 8, 2007, the law firms of Rochon Genova LLP and Siskinds LLP filed a class action on behalf of all persons in Canada (excluding Quebec) who were prescribed and ingested Oxycontin against the manufacturers of the drug, Purdue Pharma and various affiliated entities. On May 11, 2007, Siskinds’ Québec-based affiliate, Siskinds Desmeules, also filed a similar action on behalf of Québec residents. Various other law firms in Canada also filed prospective OxyContin class actions.

In 2017, the parties to various class actions (including Siskinds’ class actions) reached a Settlement Agreement to resolve the Oxycontin class action litigation across Canada. In 2017, this agreement was approved in Ontario, Quebec and Nova Scotia. In 2022, the settlement was approved in Saskatchewan.

The Canadian OxyContin Class Action Settlement has now received the required court approvals and class members can now file claims.

Anyone who was prescribed and ingested OxyContin and/or OxyNEO in Canada between January 1, 1996, and February 28, 2017, is eligible to claim under the settlement, including estates of Canadian Oxy users who have since passed away. Spouses, children, and certain other family members of approved claimants are also eligible to make claims. Class members have until June 27, 2024, to file a claim.

How do I participate in the class action settlement?

Class Members are permitted to file their own claims to the Canadian OxyContin Class Action Settlement, or they can retain a lawyer to do so on their behalf.

If a Class Member retains Class Counsel to assist them in making an individual claim for compensation to the Canadian OxyContin Class Action Settlement, Class Counsel have agreed to cap their fees at 15% of the amount awarded to the Class Member.

Who is affected by the Oxycontin class action?

You are affected by the class action and are a “member” of the class if you were prescribed and ingested Oxycontin, and/or OxyNEO in Canada between January 1, 1996, and February 28, 2017. Estates of deceased Canadian Oxy users are also eligible to file claims, as are certain people who were family members of class members during their periods of addiction, including spouses, common law spouses, children, grandchildren, parents, and siblings.

What should I do to protect my rights?

To protect your rights, you should:

• File a claim to the settlement on your own before the deadline of February 27, 2024; or
