Hanna leave to appeal denied

On Monday, the Ontario Court of Appeal denied Ian Hanna’s request for leave to appeal the decision of the Divisional Court, which unanimously rejected  his attempt to prevent Ontario from issuing renewable energy approvals for large wind turbines. Judges Goudge, MacFarland and Watt ordered costs to the respondents, the Ontario Attorney General and Canadian Wind Energy Association.

That leaves it up to the Environmental Review Tribunal to assess the technical evidence about wind turbine siting in particular cases, including claims about health effects. The ERT  is scheduled to issue its decision on these issues in the Kent Breeze appeal by July 18.
