This class action alleges that the Defendants unlawfully conspired to fix, increase, and/or maintain prices in the market for Ethylene Propylene Diene Monomer ("EPDM").

The plaintiffs allege that between January 1, 1997 and December 31, 2001, the defendants and senior executives of the corporate defendants participated in illegal and secretive meetings and made arrangements relating to price targets, specific price increases, and market share divisions for EPDM.

EPDM is a synthetic rubber used in a variety of applications.

Settlements have been reached with the defendants: Bayer Inc., Bayer A.G., Bayer Material Science A.G., Bayer Material Science LLC, Bayer Corporation, Chemtura Corporation (f/k/a Crompton Corporation), Crompton Co/Cie., Crompton Canada Corporation, Uniroyal Chemical Company Inc., DuPont Dow Elastomers L.L.C., E.I. du Pont de Nemours and Company, E.I. du Pont Canada Company, The Dow Chemical Company, Dow Chemical Inc., Exxon Mobil Chemical Company, Polimeri Europa S.r.l., Polimeri Europa S.p.A., Polimeri Europa Americas Inc., Enichem S.p.A.,Enichem Americas Inc., and Syndial S.p.A.

A settlement has been reached the remaining defendants, DSM Elastomers Europe B.V. and DSM Copolymer, Inc. The settlement has been approved by the Ontario, British Columbia and Quebec Courts.

The deadline to file a claim under this settlement was October 11, 2011. The administration of the settlements has concluded and all claims have been paid.
