The statements of claim allege that the defendants negligently or recklessly misrepresented the quantity of gold in its drill samples taken from the Boka Gold Project in China. The claim is on behalf of all persons who acquired Southwestern securities, whether pursuant to a prospectus or over the TSX, in the period December 3, 2002 to July 18, 2007 (the "class period").

The parties reached a settlement that provides for the creation of fund of $15.5 million. The Settlement Agreement may be reviewed here: [English] [French].

The Settlement Agreement was approved by the Courts in Ontario, British Columbia and Québec in late 2008, and also approved the publication of the following notice to class members: [English] [French]. The claims deadline has passed. Cheques were mailed to Eligible Claimants in June 2010.
