Siskinds LLP filed a proposed class action against FCA and Cummins alleging that illegal defeat devices were installed in certain diesel-powered Dodge RAM 2500 vehicles model years 2007-2012 and Dodge RAM 3500 vehicles model years 2007-2012.

Siskinds is of the opinion that the proposed FCA and Cummins class proceeding is no longer viable, and the representative plaintiff no longer wishes to pursue the claim against FCA and Cummins. On this basis, Siskinds sought and obtained the approval of the Ontario Superior Court of Justice to dismiss the proposed class proceeding.

The limitation period for bringing any potential claim related to the issues raised in the proposed class proceeding, if there is any time left within it, has recommenced on December 7, 2022. On the expiry of the limitation period, any right you may have to sue over these matters may be extinguished. Limitation periods vary across Canada.
