Motor vehicle personal injury litigation is one of the most complicated areas of legal practice in Ontario. Today’s current “no-fault” system is complex because in many cases there is a right to sue the driver at fault. While it may take months or years to find out if a client will be fully compensated, people involved in accidents should seek legal advice as soon as possible following an accident to ensure they comply with the short limitation periods in place. For example, the Insurance Act requires that an at-fault driver be given proper notice within 120 days of the date of the accident.
Failure to seek early legal advice often results in the client losing procedural advantages, or in some cases, losing the right to seek compensation.
Referrals from other lawyersThe Siskinds personal injury team is pleased to receive referrals from other lawyers and welcomes the referring lawyer’s continued involvement if that is the wish of the lawyer and the client. Those lawyers who do refer clients to Siskinds for a personal injury action should be aware that Siskinds would not take other work from the client without the referring lawyer’s prior approval.
Referral fees are negotiated in accordance with the Rules of Professional Conduct and based on the nature of the case.
Fair Legal FeesSiskinds is dedicated to offering clients fair legal fees that reflect the value clients receive. Fees are based on a number of factors, including the complexity of the matter, the amount of time spent advancing the client’s case, the amount of money involved and the stage at which the case is resolved.
In most cases, Siskinds does not require a monetary retainer for personal injury litigation matters. While these matters can be very expensive to advance, the firm is proud of its ability to find creative solutions that make it easier for clients to access justice.
