Our Corporate & Commercial Litigation Group is knowledgeable in all types of franchise disputes and have experience representing both franchisors and franchisees in order to effectively resolve disputes, through negotiations, mediation, arbitration or litigation.

Our Group is well equipped to respond promptly and knowledgeably to our client's legal needs, in a cost-effective, timely and practical manner, which arise from a franchise relationship, including:

  • Interpretation of the franchise agreement;

  • Advancing or defending rescission claims on behalf of a franchisee;

  • Advancing or defending claims involving misrepresentations made by either a franchisee or franchisor;

  • Advancing or defending allegations of bad faith or unfair dealing;

  • Franchisee terminations; and

  • Interim and permanent injunctions.

Members of the Siskinds Corporate & Commercial Litigation Group have participated in many forms of alternative dispute resolution, including mediation and arbitration, and have appeared on behalf of our clients in all court levels including the Superior Court of Justice, Divisional Court, Court of Appeal for Ontario and the Supreme Court of Canada and have built a reputation among our peers and the judiciary for determination, effectiveness, credibility and reliability, attributes which are crucial to achieving results.

Members of our Corporate & Commercial Litigation Group were involved in a precedent-setting cases before the Ontario courts, which has advanced the law with respect to the interpretation of the Arthur Wishart Act (Franchise Disclosure), 2000.
