Despite best efforts to ensure applicable federal and provincial standards are met, business owners and individuals can often find themselves charged with regulatory offences and facing staggering fines for non-compliance with provincial legislation.
The Siskinds Corporate & Commercial Litigation Group has experience defending both individuals and corporations against regulatory offences and prosecution from the provincial government. These specialized situations require a careful consideration of fines levied, due diligence defences available and possible Charter right infringements. Our team can review the facts and merits of a case and advise clients with respect to the most appropriate strategy to employ when defending these actions.
Our Group will negotiate settlement agreements with Crown prosecutors to have fines reduced and certain charges withdrawn. When settlement is not possible, our Group will aggressively defend against the charges at trial.
