About

Kimberly is an associate practicing in the area of medical negligence. She has significant experience in litigating medical negligence actions. Her practice focuses on helping those that have been injured through medical negligence. She has experience in representing clients before the Provincial and Superior Ontario Courts of Justice, as well as various administrative tribunals, including the Health Professions Appeal and Review Board and the Immigration and Refugee Board.

Kimberly obtained her J.D. from the University of Toronto in 2013. She articled with Siskinds and began practicing in the medical malpractice department once she was called to the bar in 2014. Prior to obtaining her J.D. degree, Kimberly graduated with High Distinction from the University of Toronto, receiving an Honours B.Sc with a specialist in Environment Science and a major in Biology in 2010.

Born and raised in the province of Newfoundland, Kimberly has come to love the Forest City. She enjoys mountain biking, hiking with her family, and reading fantasy and sci-fi novels.

Notable Work and Decisions

Obstetrical Malpractice – NST – Hypoxia – Brain Damage, Developmental Delay and Cognitive Deficits

Resolved case alleging failure to respond to non-reassuring fetal heart recordings. Standard of care failure alleged against obstetricians and nurses. Standard of care failures causing in prolonged hypoxia, brain damage, developmental delay and cognitive deficits.

General Surgical and Medical Malpractice – Failure to anti-coagulate – Stroke – Paralysis

Resolved case alleging failure to anti-coagulate an inpatient for clot prophylaxis causing stroke and quadriplegia.

Chiropractic Malpractice

Trial award of damages for back pain caused by chiropractic failures to adequately discuss the potential risks and alternatives of the proposed treatment, and failure to perform a proper examination, which led to an exacerbation of the underlying lumbar disc herniation.

Deboer v. Dr. D.M. Kolyn et al., 2016 ONSC 7108

Trial decision awarding damages to the plaintiff for breaches of the standard of care by a radiologist and a general surgeon which delayed the diagnosis of the Plaintiff’s breast cancer. The Trial Judge held that but for the Defendants’ negligence, the Plaintiff would not be suffering from cancer metastases in her bones and would not die prematurely from this disease.
